Protect Law Clinic Client Calls in a Shared Apartment

Protect law clinic calls with a private room, case-free household calendar, clean desk, and clinic-approved fallback.

A law student should take a clinic client call from a shared apartment only when the clinic permits remote work and the student can prevent other people from hearing or seeing case information. Convenience is not enough. If privacy cannot be maintained, move the call to a clinic-approved room.

ABA Model Rule 1.6 says a lawyer must not reveal information relating to a representation except in defined circumstances and must make reasonable efforts to prevent unauthorized access or disclosure. Law students must follow their clinic’s rules and supervising attorney’s direction, which may be stricter or jurisdiction-specific.

Establish a client-call perimeter

Reserve a closable room with an overrun buffer. Use a case-free calendar entry such as “private clinic call,” never a client name, court, legal issue, or opposing party. Put a neutral sign outside and tell housemates that only an immediate safety emergency justifies entry.

Wear headphones, but also check whether your own voice carries into the hall or adjoining room. Move the call if it does. Turn off smart speakers and household cameras within listening or viewing range. Frame the screen so no roommate belongings, mail, or visitors appear behind you.

Use clinic-approved devices, platforms, phone numbers, and authentication. Do not place a client on speakerphone. Do not ask a roommate to announce calls, take messages, scan a letter, or confirm whether you are home. Even a name linked to a legal clinic can disclose more than intended.

Keep the desk clear before and after the call

Bring out only the material approved for the call. Cover windows or reflective surfaces if they expose the screen. Keep a drink away from original documents, and never leave papers face up while stepping out.

When the call ends, finalize notes in the approved system, lock the device, and return physical material to its authorized container. Check the printer tray, wastebasket, and handwritten scratch pad. Follow the clinic’s return and destruction instructions. Household recycling is not an acceptable default for case material.

If a housemate enters, an assistant hears background speech, or the call drops onto speaker, stop and restore privacy. Tell the supervising attorney promptly through the approved channel. The student should not make a private judgment that the exposure was harmless.

Separate legal work from household favors

A roommate may reasonably accept a generic request for quiet, but they should not become unpaid clinic support. Do not ask them to proofread correspondence, interpret a voicemail, locate a party online, or drive papers to court. Those tasks may reveal protected information and bypass supervision. If the student needs administrative help, the request belongs with the clinic. Keep household cooperation limited to room access, ordinary noise, and emergency interruption.
